Declining the EHR Incentive Program

What will happen if an Eligible Provider choses to not participate in the Medicare EHR Incentive Program?

As part of the American Recovery and Reinvestment Act of 2009 (ARRA), Congress mandated payment adjustments to be applied to Medicare eligible professionals (EPs) who are not Meaningful Users of Certified Electronic Health Record (EHR) Technology. An EP becomes a meaningful EHR user when they successfully attest to Meaningful Use under either the Medicare or Medicaid EHR Incentive Program.

These payment adjustments will be applied beginning on January 1, 2015, for Medicare EPs. In order to avoid the 2015 payment adjustment, the EP must attest no later than October 1, 2014, which means they must begin their 90 day EHR reporting period no later than July 1, 2014.

Medicaid EPs who can only participate in the Medicaid EHR Incentive Program and do not bill Medicare are not subject to these payment adjustments.
